    Saya berumur 24 tahun.Sy dah ada buat pinjaman utk sebuah kereta,superbike dan asb loan 200k.Skg bru terfikir nak beli rumah. So dlm proses nak beli rumah flat, 2 biji terus. Dijual pada harga RM70k setiap satu. Rumah sebelah2. So beli dua2 , jadi RM140k. Rumah tu second hand lah,mereka nak jual. So mmg teringat nak pecahkan dan combine jadi satu rumah. So cmna dia nak kira nanti psal kos2 semua tu? Kira asing2 atau sekali? Sebab kan dua rumah terus. Agak2 apa caj yg akan dikenakan utk rumah harga RM140k tu?
    Utk pengetahuan Tuan, sy berniaga. Iaitu membuka pusat tuisyen. Baru daftar 7 bulan.Pdahal dah operate hampir 2 tahun. Tax pun belum isytihar lagi sebab belum genap 1 year. Dulu beli kereta pun, bank release 71k wktu umur 22 tanpa guarantor dan tanpa bisnes register.Boleh plak lulus. Kemudian asb loan 200k lepas plak, padahal bisnes bru register 2bulan..Superbike beli pakai loan kedai.So x termasuk dlm mana2 catatan pun. Cuma nak tnya,rasa2 boleh dpt ke loan utk rumah kalau tax pun tak istihar lagi,bisnes pun 7 bulan bru.Leh beli ke rumah harga 140k tu?

      Tahniah kerana berjaya dalam bisnes yang diceburi. Mengikut data yang diberikan kebiasaannya bank akan mengira kadar komitmen semasa tuan sebelum dia meluluskan permohonan. Apa pun saya nasihatkan tuan untuk mempunyai rekod akaun yang sistematik dan pinjaman yang tuan buat di atas akan dikira sebagai komitmen semasa.

      Bagi pembelian rumah di atas, ia akan dikira dua transaksi berbeza dan caj yang dikenakan juga akan didarab 2.

      Bagi permohonan pinjaman pula, bagi perniagaan, sesetengah bank memerlukan rekod perniagaan selama 2 tahun (Laporan Audit Syarikat).
      Buat masa ini, tuan sediakan rekod akaun dan cuba bertanya dengan pihak bank sama ada layak untuk membuat pinjaman dalam masa terdekat atau perlu tunggu selepas 2 tahun.

      Maaf mungkin agak lambat saya reply pertanyaan tuan.
      Jika rumah harga RM258K dan katakan tuan membuat pinjaman hanya 90%,
      kos anggaran seperti berikut:
      Caj peguam RM2,256(RM150K pertama:1%, RM850K seterusnya:0.7%)
      Duti Setem SNP RM4,160(RM100K pertama:1%, RMRM400K seterusnya:2%)
      Duti Setem Loan RM1,165(Anggaran Jumlah pinjaman x 0.5%)
      Jumlah keseluruhan RM7,581

      Jumlah di atas adalah anggaran kos yang dikenakan oleh pihak peguam. Mungkin ada tambahan dari segi kos-kos dokumen dan pengangkutan.

      Boleh saya tahu sama ada tuan buat mark up loan atau buat pinjaman mengikut harga jualan yang dipersetujui?

      Lagi satu, dapatkan dulu sebut harga untuk khidmat peguam di atas dan minta dia terangkan caj setiap item.

    Salam tuan…saya baru membeli sebuah rumah teres 2 tingkat di meru perdana,Ipoh…harga belian adalah sebanyak RM 339,000..pihak pemaju telah memberikan diskaun 5% untuk hrga belian….tetapi loan yg saya mohon masih lg sama iaitu 339000…n utk pembelian ini juga pihak pemaju telah menanggung semua kos guaman, perjanjian SAP…cuma sya hanya perlu byar utk kos pindah hak milik sebanyak 1%…soalan sya layakkah sya menerima diskaun 50% untuk duti setem bagi caj peguam utk pembelian rumah pertama jika semua kos guaman ditanggung oleh pemaju?

      Terima kasih atas bayaran. Mengikut perkiraan asasnya, duti setem yang dikenakan adalah atas perjanjian jual beli dan juga perjanjian pinjaman. Diskaun 50% yang tuan maksudkan adalah pengecualian yang diberikan oleh pihak LHDN kepada pembeli sekali seumur hidup. Caj peguam adalah caj yang dikenakan ke atas pembeli atas urusan yang dilakukan oleh pihak peguam untuk melengkapkan transaksi ini. Tuan boleh berunding dengan pihak peguam yang menguruskan transaksi jual beli ini untuk permohonan diskaun 50% itu.

        Salam tuan,
        Mengikut penerangan tuan ini, saya dapat simpulkan hanya 2 cara saja untuk tuan dapat membayar kos-kos di atas. Since tuan sudah dapat 90% pinjaman, maka yuran guaman adalah perlu ditanggung oleh tuan sendiri. Kebiasaannya sebelum ini ada sesetengah bank yang menawarkan pinjaman 90%+5% yang 5% itu adalah untuk menanggung kos-kos lain seperti kos peguam.
        Mula-mula cuba minta diskaun atas kos guaman yang dikenakan dan dalam masa yang sama cuba dapatkan kebenaran dari pihak peguam untuk membayar kos itu secara ansuran. Kebanyakkan peguam akan sedia membantu pembeli berkaitan kos – kos peguam ini.
        Harap jawapan saya membantu tuan dalam urusan jual beli ini.

      Sebelum saya menjawab persoalan tuan, boleh saya tahu rumah ini dibeli dari pemaju atau rumah dibeli atas tangan orang(subsale)?
      Adakah urusan jual beli ini diuruskan oleh tuan sendiri atau melalui agen. Jika melalui agen sepatutnya, dia perlu menerangkan prosedur jual beli dan kos-kos yang perlu tuan bayar untuk mendapatkan rumah itu.

      Kalau mengikut perkiraan biasa, kos yang terlibat selain dari deposit 10% adalah seperti berikut:
      Yuran peguam RM 1640, Duti setem – SNP RM2400, Duti setem – Loan agreement RM850
      Jumlah keseluruhan RM4890
      Berkenaan diskaun setem duti memang layak mendapat diskaun sekali seumur hidup. Mungkin tuan boleh berunding dengan pihak peguam untuk mendapatkan pengecualian 50% atas kos duti setem di atas.

      Boleh saya tahu berapa jumlah loan yang cik Miza dapat? Saya assume cik tidak dapat 90% loan dari bank kan?
      Kalau ikutkan caj yang lawyer kenakan agak berpatutan, mungkin cik boleh minta pihak lawyer beri diskaun atas caj yang dikenakan.
      Adakah ini kali pertama cik membeli rumah? Jika ya, mungkin boleh minta lawyer dapatkan pengecualian dalam 50% atas setem duti bagi Perjanjian Jual Beli(SPA).Pengecualian ini hanya dapat sekali seumur hidup sahaja.

          Yer, pengecualian duti setem atas perjanjian jual beli layak diberi kepada pembeli sekali seumur hidup. Kalau untuk perjanjian pinjaman(loan agreement) masih kena bayar penuh.
          Apa pun tahniah diucapkan sebab akan dapat menduduki rumah sendiri tidak lama lagi. Cuma selepas ini, jika ingin membeli rumah, boleh minta qoutation dari 2 lawyer yang berlainan untuk dibuat perbandingan dari segi caj yang dikenakan.Dari situ, Cik Malisa boleh tahu sama ada caj yang dikenakan mahal atau mengikut standard caj.

      Jika tuan kurang mahir dengan urusan jual beli, adalah dinasihatkan guna saja khidmat agen kerana jika tidak mahir mungkin tuan akan terpaksa menunggu lama untuk mendapatkan rumah idaman atau membayar lebih dari yang sepatutnya. Lagipun fee agen bukan dibayar oleh tuan sebaliknya dibayar oleh tuan rumah.
      Mengenai pinjaman melebihi melebihi 100%, maaf saya kurang pasti kerasa biasanya pihak bank hanya memberi pinjaman 90% daripada harga pasaran semasa hartanah itu.

      Bagi urusan jual beli yang biasa saya uruskan sebagi perunding hartanah, professional fee saya akan dibayar oleh pihak owner. Cuma pembayaran ini dibuat melalui duit booking yang pembeli letak sebagai earnest deposit/booking dalam 3%. Mungkin puan boleh hubungi owner untuk bertanya adakah owner ada melantik broker ini untuk menguruskan dan menerima bayaran bagi pihak owner.

    Isteri saya berkerja di sebuah bank Dan mempunyai benefit untuk mendapat 4% fix loan interest. Namun isteri saya suda pernah membeli rumah bernilai 100k.

      Kalau mengikut senario tuan, pengecualiaan yang dikenakan adalah atas duti setem untuk perjanjian jual beli(SPA). Sekiranya pinjaman atas nama isteri tuan, sudah semestinya namanya dimasukkan di dalam SPA dan secara automatik pihak tuan tidak dapat pengecualian tersebut.

      Walau apa pun, minta tuan refer lawyer yang kendalikan kes ini untuk maklumat lanjut.

      Saya kurang pasti berkenaan bayaran ejen itu kerana biasanya untuk di KL dan Selangor, bayaran agen akan ditanggung oleh pihak owner/penjual. Dan bayaran itu adalah dibayar oleh pembeli sebagai earnest deposit/booking 3% dari harga jualan. Bayaran peguam pula sila minta sebut harga atas sebelum membuat bayaran dan minta lawyer terangkan setiap caj yang dikenakan.
      Berkenaan tax 30% itu, saya memang tidak pasti atas kos apa yang dikenakan itu. Minta agen itu terangkan secara detail dan kalau boleh rujuk kepada peguam/agen hartanah yang encik kenal untuk pengesahan atas setiap kos berkenaan.

        Apakah itu RPGT secara terperinci.

        Untuk makluman tuan saya sedang membeli rumah yang mana pemiliknya adalah sebuah syarikat agen jual beli rumah. Rumah ini dibeli secara lelongan dan telah diubahsuai oleh syarikat tersebut.
        Bermaksud pembelian rumah ini kurang 5 tahun dari pemilik (syarikat) tersebut. Adakah sebagai pembeli baru saya yang kena tanggung TAX kerajaan tersebut.

      Kosnya guaman murah sedikit disebabkan tiada perjanjian jual beli(maka tiada duti setem). Untuk kes lelong, dokumen yang digunakan adalah kontrak jualan yang kos duti setemnya agak murah. Cuma bagi kos rumah lelong, perlu sedia sedikit bajet untuk membaiki keadaan rumah atau tunggakan bil-bil utiliti dan penyelenggaraan.

      Pengecualiaan duti setem 50% itu boleh digunakan sekali seumur hidup tidak kira sama ada puan guna pinjaman bank atau kerajaan.

      Pengiraan duit lawyer ada formula tertentu yang mana biasanya saya akan minta lawyer yang biasa saya gunakan untuk kirakan. Mungkin boleh refer di website seperti http://lowpartners.com/calculator.php untuk dapatkan anggaran kos guaman terlibat.

      Untuk transaksi jual beli, kebiasaannya deposit sebanyak 10% diperlukan. Yang mana 3% sebagai booking dan baki 7% dibayar semasa menandatangani SNP kepada pihak peguam. Dalam kes ini, saya rasa mungkin pihak penjual bersetuju untuk memberi agen itu mengutip 3.5% daripada pembeli yang mana 0.5% itu untuk menanggung kos GST bagi transaksi itu. Apa pun minta penjelasan dari agen itu berkenaan tambahan 0.5% itu dan tanyakan semasa sign SNP berapa baki yang perlu dijelaskan samaada 6.5% atau 7%(untuk digenapkan 10%)?

      Jika transaksi dibatalkan adalah disebabkan pembeli gagal mendapat pinjaman, agen akan memulangkan duit booking itu 100% dengan syarat pihak pembeli mengemukakan rejection letter dari bank. Jika pembeli sengaja membatalkan urusan jual beli tanpa alasan yang kukuh, pihak agen ada hak untuk tidak memulangkan booking yang telah dibayar. Apa pun sebelum membayar booking, minta agen itu memberi penerangan secara menyeluruh berkenaan proses dan sebagainya.

    sy ada satu kemusykilan. Utk loan legal fee, adekah fee itu dibayar kpd lawyer yg same yg menguruskan SNP ataupun kpd lawyer yg diamanahkan oleh pihak bank?
    Baru2 ini sy ade membeli sebuah rumah, & mengikut kate pegawai bank tersebut, tiada caj utk legal fee sbb company saye ialah client di bank tersebut.
    Tp apabila lawyer yg menguruskan S&P memberi quotation, sy terkejut kerana total bayaran adalah termasuk Tawarruq facility agreement & stamp duty on tawarruq FA (~RM6.5k).
    Soalan sy, adakah legal fee yg dimention oleh pegawai bank td berlainan the tawarruq FA ini. agak confuse.

      Untuk pembelian hartanah yang menggunakan pinjaman akan ada 2 perjanjian iaitu Perjanjian Jual Beli dan Perjanjian Pinjaman. Pembeli ada hak untuk memilih sama ada menggunakan lawyer yang sama atau berlainan untuk kedua-dua perjanjian. Di antara caj yang dikenakan bagi kedua-dua perjanjian ini adalah duti setem dan juga legal fee.
      Bagi kes Cik Wawa, saya rasa harga yang dikenakan untuk Tawaruq itu adalah untuk duti setem. Duti setem ini adalah caj wajib dibayar oleh setiap pembeli/peminjam yang mana LHDN melantik lawyer untuk memungut bagi pihaknya untuk transaksi jual beli atau pinjaman. Duti setem yang dikenakan bergantung kepada harga rumah yang ingin dibeli. Saya rasa Cik Wawa akan dikenakan bayaran lebih lagi sekiranya pihak lawyer memasukkan legal fee dalam quotation itu tetapi disebabkan keistimewaan syarikat cik bekerja menyebabkan cik mendapat pelepasan legal fee.

    Maaf sy tersilap memberi figure yg kurang jelas di atas.
    Total bayaran yg dikenakan oleh peguam sy ialah RM26.4k utk rumah yg berharga RM600k (tidak termasuk deposit rumah).
    Sy sudah menyemak itemize cost, dan merasakan semuanya adalah di dlm range tuan (merujuk artikel ini).
    Tetapi sy tidak faham kenapa kos utk loan legal fee (~6.5k) termasuk di dalam bayaran total diatas sedangkn menurut pihak bank mereka tidak mengenakan sebarang caj utk permohonan loan sy kerana client privilege (company).
    Adakah pihak peguam berhak utk mengecaj fee ini?
    Mohon pandangan tuan utk perkara ini.

            Untuk permohonan loan, dokumen tuan slip gaji, penyata bank, penyata kWSP, Income tax, Simpanan seperti ASB/Tabung Haji, salinan SNP lama, Salinan geran, bil utiliti berkaitan. Boleh buat sendiri tapi jika kurang arif berkenaan prosesnya, takut akan memakan masa. Boleh saja minta agen bantu bagi mempercepatkan proses.

      Ia bergantung kepada status tanah dan jika membuat pinjaman bagi pembelian tanah, pihak bank tidak memberi 90% seperti pembelian rumah. Jika tidak mendapat 90% pinjaman, maka kos duti setem dan caj peguam ada pengurangan bergantung kepada jumlah pinjaman yang diperolehi.

    saya masih dlm proses jual rumah saya. apa yg saya tidak faham ialah masa yg di ambil sgt lama. kami telah tandatangan S&P pada bulan Mei 2015. Dan sehingga kini saya masih belum dapat baki bayaran. utk makluman rumah tersebut masih ada hutang bank. Dan baru2 ini kami terima update mengatakan bahawa peguam baru terima dokumen dari bank pembeli dan pihak peguam mengata kami perlu tunggu lagi 1 1/2 bulan untuk dapatkan baki rumah .

    Memang prosedur jual beli rumah akan ambil masa sehingga 5-6 bulan kah?

      Bagi proses jual beli rumah yang berstatus freehold dan melibatkan pinjaman bank, purata proses dari mula hingga selesai lebih kurang 3-4 bulan. Bagi rumah yang berstatus leasehold akan ada tambahan selama 2 bulan disebabkan peguam perlu mendapatkan kebenaran dari kerajaan negeri sebelum boleh melakukan proses seterusnya. Jika ada hutang dengan bank lagi, akan ada 2 kali disbursement disebabkan disbursement pertama untuk meneyelesaikan hutang dengan bank cik dan selepas itu baru cik akan dapat bahagian cik. Apa pun sentiasa berhubung dengan peguam untuk mendapatkan update seterusnya.

Mungkin boleh berhubung dengan lawyer secara kerap untuk mendapatkan update berkenaan kes ini.
        Ya, ada GST akan dikenakan bagi caj guaman jual beli dan pinjaman.

    Saya dalam proses membeli subsale house di Kudat pada harga RM255000 straight from owner.utk pengetahuan tuan,owner membeli secara cash pada Disember 2011 dengan harga RM200,880. Saya sudah berjumpa dengan pegawai Maybank utk pinjaman perumahan. Pegawai tersebut telah mendapatkan nilai dari beberapa valuer. Nilai paling tinggi adalah RM230000. Maybank hanya meluluskan 90% nilai pinjaman. Saya perlu mengeluarkan 10% d/p(RM25500).

    Soalan saya
    1. Loan yg lulus adalah 90%(RM207000). Saya perlu ada cash in hand sebanyak RM23000. Kepada siapa dan bila saya perlu menyerahkan RM23000 tersebut?
    2. 10% (RM25500) saya perlu bayar pada owner. Adakah saya bayar kpd owner atau peguam?
    3. Sekiranya perkara tidak diingini berlaku (penjual tarik diri,penjual meninggal dunia etc) dalam tempoh proses jual beli sehingga full disburse,apa akan jadi pada 10% d/p saya tadi?
    4. Berapa anggaran kos keseluruhan peguam?

    Saya telah membeli rumah bernilai 643k.10% telah diberi disc oleh pemaju.loan saya hanya lulus 80%. So saya kena bayar 64k tambahan lagi pada pemaju. Saya telah bayar 45k.masih berbaki 19k dan menghadapi sedikit masalah kewangan baru2 ini.tak.mampu nak selesaikan baki tersebut. Saya ingin batalkan pembelian rumah tersebut dan pemaju tidak mahu mengembalikan deposit 45k tersebut.setelah rayuan dibuat, pemaju hanya bersetuju mengembalikan 20k sahaja.snp saya telah sign dengan pemaju.Letter offer bank masih belum saya sign kerana loan saya bersyarat.saya perlu letak placement 15k sblm sign lo.sy memutuskan dengan pihak bank utk menyelesaikan balance sum dgn pemaju dahulu sblm buat placemnt ke bank.ini kerana selagi saya xselesaikan baki 10% deposit dgn pemaju, pemaju takkan hantar release letter ke bank untuk bank buat disburtment pd pemaju.apa yang perlu saya buat sekarang?

      Adakah puan meneruskan dengan proses pembelian atau membatalkannya?
      Sekiranya meneruskan pembelian, sememangnya pihak pembeli perlu membayar deposit seperti yang dipersetujui di dalam perjanjian jual beli(SNP). Mungkin puan boleh rujuk semula SNP yang ditandatangani dan rujuk klausa yang berkaitan pembayaran deposit & pembatalan pembelian.
      Dalam kes ini, puan boleh rujuk dengan peguam yang mengendalikan kes puan untuk tindakan lanjut. Saya tidak dapat memberi sebarang recommendation kerana kurang pasti akan kandungan perjanjian jual beli yang ditandatangani.

      Kes puan ini ada sedikit kerumitan yang berlaku. Walaubagaimanapun, saya telah merujuk kepada peguam dan responnya adalah seperti berikut:
      1. Sekiranya pihak bank pembeli belum membayar kepada baki hutang pinjaman kepada bank puan, maka perjanjian jual beli(SNP) itu telah terbatal.Melainkan telah dinyatakan di dalam SNP tersebut.
      Sekiranya terbatal, maka puan perlu memulangkan semula segala bayaran yang tealh dibuat oleh pembeli itu kepada pihak puan. Selepas itu baru puan boleh menuntut MRTA seperti yang dinyatakan di atas.

      2. Sekiranya bank pembeli telah melunaskan baki pinjaman kepada bank puan, maka puan tidak layak untuk menuntut MRTA seperti yang dinyatakan di atas.

      Apapun, minta rujuk kepada peguam yang mengendalikan kes jual beli puan ini untuk mendapatkan second opinion.

      Mengikut belanjawan 2015 yang dibentangkan, pengecualiaan hanya diberi untuk pembeli rumah pertama dengan maksimum harga RM500k.

    Assalamualaikum tuan..saya dalam proses membeli rumah subsale yang berharga rm220k. Bank loan approve di mana saya mendapat 90% pinjaman. Saya ada berjumpa dengan peguam utk membincangkan berkaitan kos peguam yg perlu dibayar.

    Jadi, total cost bagi lawyer fee + SNP agreement adalah rm4700, manakala cost bagi lawyer fee + loan agreement adalah rm5000. Total adalah rm9700. Pada pendapat tuan, adakah kos tersebut berpatutan?

Agent yang menjual telah menetapkan syarat bahawa rumah tersebut terhad kepada pasangan sudah berkahwin dan mmpunyai pendapatan bawh 5k, mastautin @ lahir di selangor dan rumah pertama. agent tersebut telah menyatakn bahawa kos guaman yang dikenakan adalah dalam lingkungan 5k. 1) Adakah betul kos peguam yang dinyatakan. 2) bayaran peguan yang dicas perlu dibayar pada masa bila, sebelum @ selepas loan diluluskan serta bila kena mula membayr cas tersebut. terima kasih

    Saya dalam proses beli hartanah berharga Rm230k. Loan saya lepas untuk 80% sahaja. 3% sudah pun bayar untuk booking. 7% lagi utk baki deposit. Agen dah inform awal2 utk sediakan legal fee SPA + loan agreement dalam rm11k. Jika saya pakai 2 lawyer yang berbeza, RM11k ini total cost yg perlu bayar untuk kedua2 lawyer ini ke…? atau Rm11k ini cost untuk lawyer yg uruskan SPA sahaja. lawyer bank cost lain.. mohon penjelasan daripada tuan Anuar.

    Assalam Tuan, boleh tuan terangkan mengenai cara pengiraan harga laporan penilaian harta (valuation report) sekiranya rumah berharga RM330,000?

    Saya telah menghantar permohonan laporan penilaian kepada JPPH, dan harga untuk penilaian sy adalah didapati sebanyak RM330. Namun pihak JPPH enggan menerangkan cara pengiraan harga tersebut.

    Adakah secara kasarnya, RM330 itu datang dari 0.1% dari harga rumah?

    Saya dpt tawaran membeli rumah pertama jenis bertingkat bernilai 90k . Snp belum sign lg. sewaktu cabut undi bagi menentukan unit, pemaju mengatakan watuk sign snp perlu bayar 2% dr harga rumah dan rm500 duit lawyer. Boleh tak tuan jelaskan anggaran kos sebenar/tersembunyi yg sy perlu sediakan untuk urusan berkenaan. Pinjaman bank 90% masih dlm proses. Dan dan adakah maksud duit lawyer tu dah termasuk SNP Legal Fee + Stamp Duty + Disbursement
